a few of my favorite things

Krissa has up a blog post covering a few of my favorite things:

  • reminiscing about our first trip to paris
  • a warm goat cheese salad
  • a beautiful picture (using the new lens I got her for her birthday)(need to mess with whitebalance, still…)
  • the ability to get lots of fresh food right here in the city

Big hugs to my love… and then back to Criminal Law. Hopefully some pictures from our weekend in Cali later tonight once I burn out on murder most foul.

very slightly more on the defense of necessity

I mentioned yesterday that we read a torture case as part of my criminal law class’s reading on the defense of necessity. Today in class the professor suggested reading ‘Cannibalism and the Common Law.’ Cannibalism, torture- all in a day’s work for a law student, apparently.

[In case you're wondering what cannibalism has to do with anything that could possibly be useful in a modern criminal court, read the brief but interesting wikipedia article on the case in question. But only if you have a strong stomach.]

Israeli Supreme Court on Torture

We are aware that this decision [banning torture] does not ease dealing with that reality [of terrorist attacks on Israelis.] This is the destiny of democracy, as not all means are acceptable to it, and not all practices employed by its enemies are open before it. Although a democracy must often fight with one hand tied behind its back, it nonetheless has the upper hand. Preserving the Rule of Law and recognition of an individual’s liberty constitutes an important component in its understanding of security. At the end of the day, they [add to] its strength…
